Subject: Microsoft Campus Agreement Faculty/Staff Usage Policy

Purpose:

To ensure compliance with the Microsoft Campus Licensing Agreement entered into by Minnesota State Colleges and Universities

Policy:

  1. Any Pine Technical College employee may under the terms of the Microsoft Campus Agreement, purchase a copy of the listed software products for installation on home personal computer.
  2. Pine Technical College may purchase copies of the media from GE Capitol or replicate the media from media purchased through GE Capitol.
  3. Pine Technical College cannot purchase or copy more media than FTEs purchased.
  4. Faculty and staff licenses may be from media purchased from GE Capitol or replicated by Pine Technical College from media purchased through GE Capitol. These licenses may be distributed through the bookstore for cost plus a $1 per CD markup.
  5. A signed Microsoft Campus Agreement Faculty/Staff Usage Form must be kept on file for each employee participating in the program
  6. Installation of the product is at the employee's own risk. Pine Technical College assumes no liability for the installation of the product on an employee's personal computer and can not offer support for the home use of the product.

Microsoft Campus Agreement Summary:

1. GRANT OF LICENSE. Licensor hereby grants you the right to run a copy of the version number and language of the Software Product(s) identified below which you have installed on your office and home PC per the right granted to you by the Institution under the Campus Agreement Program. Your right to use each Software Product shall be governed by and subject to the relevant section(s) of the most current License Agreement, which you may view at www.microsoft.com/education/pricing/campus agree.

2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.

3. COPYRIGHT. All title and copyrights in and to the SOFTWARE PRODUCT (including but not limited to any images, photographs, animations, video, audio, music, text, and "applets" incorporated into the SOFTWARE PRODUCT), and any copies of the SOFTWARE PRODUCT are owned by Microsoft or its suppliers. The SOFTWARE PRODUCT is protected by copyright laws and international treaty provisions. Therefore, you must treat the SOFTWARE PRODUCT like any other copyrighted material except that you may install the SOFTWARE PRODUCT on a single computer provided you keep the original solely for backup or archival purposes. 

4. LIMITED WARRANTY AND DISCLAIMERS: You are provided with a 90-day product warranty and Year 2000 warranty, the terms of which are in your License Agreement. EXCEPT FOR THE LIMITED WARRANTY PROVIDED IN THE PRECEDING SENTENCE, TO THE MAXIMUM EXTENT PERMITT7ED BY APPLICABLE LAW, WE DISCLAIM ON OUR OWN BEHALF AND ON BEHALF OF OUR AFFILIATES ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE PRODUCTS AND RELATED MATERIALS. THERE MAY BE SITUATIONS IN WHICH YOU HAVE A RIGHT TO CLAIM DAMAGES FROM US. WHATEVER THE BASIS FOR YOUR CLAIM (SUCH AS BREACH OF CONTRACT OR TORT), OUR LIABILITY WILL BE LIMITED TO DIRECT DAMAGES UP TO THE AMOUNT YOU HAVE PAID UNDER THIS AGREEMENT WITH RESPECT TO THE PRODUCT GIVING RISE TO YOUR CLAIM. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE OR ANY OF OUR AFFILIATES OR SUPPLIERS BE LIABLE FOR ANY INDIRECT DAMAGES (INCLUDING, WITHOUT LIMITATION, CONSEQUENTIAL DAMAGES, DAMAGES FOR LOSS OF PROFITS OR REVENUES, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER LOSS) ARISING IN CONNECTION WITH THIS AGREEMENT, ANY ENROLLMENT OR PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Installation of the product is at the employee's own risk. Pine Technical College assumes no liability for the installation of the product on an employee's personal computer and can not offer support for the home use of the product.

Procedure:

Any Pine Technical College faculty or staff member who would like to participate in the campus licensing agreement should follow the following procedure.

  1. Obtain a copy of the Microsoft Campus Agreement Faculty/Staff Usage Form from the policy directory on the shared network drive (S:\POLICIES\POL706 MS Campus Agreement Form)
  2. Sign the form and deliver it deliver it to the Technology Director for processing along with a memo listing the media desired.
  3. The Technology Director will pool the orders and fill out a purchase requisition and deliver it to the bookstore
  4. The Bookstore will order the media and inform the employee when the product arrives
  5. The employee will purchase the ordered product through the bookstore
  6. All media sales are final and the media is sold on an "as is" basis. Pine Technical College assumes no responsibility beyond the contract for the installation and use of the media.

Responsibilities:

Information Systems:

  1. Maintain a file of completed Microsoft Campus Agreement Faculty/Staff Usage Forms
  2. Complete purchase requisitions for the products requested

Bookstore:

  1. Process completed purchase requisitions
  2. Notify the employee when the product arrives
  3. Sell the media to the employee through the bookstore

Dissemination:

Managers on the Leadership Team will inform and provide the policy to employees in their units.
A copy of the signed Microsoft Campus Agreement Faculty/Staff Usage Form will be made available to each faculty, staff or student upon request.
Faculty members and employees may obtain the policy from the Business Office, Media Center and NetWare's shared directory.
The President may provide the policy to third parties and outside agencies.
